Clans.AI User Agreement

Effective August 15, 2024. Last Revised August 15, 2024.

Clans.AI operates numerous distinct online communities. This User Agreement, along with your behavior, facilitates this reality.

This Clans.AI User Agreement (“Terms”) governs your access to and use of the websites, mobile apps, widgets, APIs, emails, and other online products and services (collectively, the “Services”) provided by Clans.AI, Inc. (“Clans.AI,” “we,” “us,” or “our”).

Clans.AI is designed for enjoyment and aims to be a source of entertainment, but adherence to basic rules is required. By accessing or using the Services, you agree to comply with these Terms. If you disagree with these Terms, you should not access or use our Services.

1. Access to the Services

Individuals under 13 are prohibited from using or accessing the Services. Certain Services may have additional age requirements, so please review all notifications and any Additional Terms carefully.

By using the Services, you confirm that:

  • You are at least 13 years old or the minimum age required by the laws of your country to access and use the Services;

  • You can form a binding contract with Clans.AI, or if you are over 13 but under the legal age of majority in your jurisdiction, that your legal guardian has consented to these Terms;

  • You are not prohibited under any applicable laws from using the Services;

  • You have not been permanently suspended or removed from the Services.

If you accept these Terms on behalf of another entity, such as a business or government entity, you confirm that you have the authority to bind that entity to these Terms.

2. Privacy

Clans.AI’s Privacy Policy details how we collect, use, and share information about you when you access or use our Services. By using the Services, you consent to the collection and use of this information as outlined in the Privacy Policy.

3. Your Use of the Services

Subject to your ongoing compliance with these Terms, Clans.AI grants you a personal, non-transferable, non-exclusive, revocable, limited license to install and use a copy of our mobile application obtained from a legitimate marketplace on your mobile device, and to access and use the Services. All rights not explicitly granted are reserved by us.

You may not, without our written consent:

  • License, sell, transfer, assign, distribute, host, or commercially exploit the Services or Content;

  • Modify, make derivative works of, disassemble, decompile, or reverse engineer any part of the Services or Content;

  • Access the Services or Content to create a similar or competitive website, product, or service, except as permitted by any Additional Terms.

We continually improve our Services, which means we may add or remove features, and we reserve the right to modify, suspend, or discontinue the Services at any time without notice. Any future releases, updates, or additions to the functionality of the Services will be subject to these Terms.

4. Your Clans.AI Account and Account Security

To use certain features of our Services, you may need to create a Clans.AI account (an “Account”) and provide information such as username, password, and other personal details as detailed in the Privacy Policy.

You are responsible for all activities under your Account and must maintain its security. Notify Clans.AI immediately if you suspect any unauthorized use of your Account. We recommend using a strong, unique password for your Account and enabling two-factor authentication.

You must not license, sell, or transfer your Account without our prior written approval.

5. Your Content

The Services may include various forms of content (e.g., text, links, graphics, photos, videos), including content you create or submit (Your Content). We do not endorse, support, or guarantee the accuracy of Your Content.

By submitting Your Content, you grant Clans.AI a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, sublicensable license to use, modify, distribute, and display Your Content in all media. This license allows us to make Your Content available for syndication and remove any associated metadata.

You are solely responsible for Your Content and may face liability if you post or share without necessary rights.

Any feedback about Clans.AI or our Services is voluntary, and we may use your ideas without obligation or compensation.

We reserve the right to delete or remove Your Content for any reason, including policy violations or potential legal liability.

6. Third-Party Content, Advertisements, and Promotions

Our Services may include third-party content, which is not under our control. You engage with third-party content at your own risk. Our Services may also display advertisements, the nature and targeting of which are subject to change without notice.

If you run a promotion on Clans.AI, you are responsible for its legality and must clearly state that it is not sponsored by Clans.AI. We will not assist with promotions, which are conducted at your own risk.

7. Prohibited Activities

You must comply with all applicable laws and regulations when using the Services. Our Content Policy, incorporated by reference, details prohibited activities and content.

Do not:

  • Interfere with the Services;

  • Access the Services to harvest or collect data without authorization;

  • Introduce viruses or harmful code;

  • Infringe others' rights or violate laws through the Services.

  • Report any violations or security issues to security@clans.ai.


8. Moderators

Moderating is voluntary and not officially endorsed by Clans.AI. We may revoke moderating privileges without notice. Moderators must not act beyond their scope of authority and must comply with our Moderator Code of Conduct.

9. Copyright, Trademark, DMCA, and Takedowns

We respect intellectual property and adhere to policies that address the removal of infringing content and the termination of infringing users. If you believe content on our Services infringes, you may contact us via email at hello@clans.ai.

10. Paid Services

Certain Services may require payment. These are governed additionally by our Clans.AI Premium and Virtual Goods Agreement.

11. Intellectual Property

The Services are owned by Clans.AI and are protected by various intellectual property laws. You may not use content from the Services without authorization, except as permitted by these Terms.

12. Indemnity

You agree to defend and indemnify Clans.AI against any claims related to your use of the Services or Your Content.

13. Disclaimers and Limitations on Liability

The Services are provided "as is" without warranty. Clans.AI is not liable for indirect damages or losses related to these Terms or the Services. The total liability of Clans.AI entities will not exceed the greater of $100 or the amount paid by you in the past six months.

14. Governing Law and Venue

Disputes related to these Terms will be governed by Singapore law, without regard to conflicts of law principles, and will be adjudicated exclusively in Singapore.


15. Changes to these Terms

We may update these Terms and will notify you of significant changes. Continued use after changes indicates acceptance of the new Terms.

16. Additional Terms

Certain Services may require acceptance of additional terms. These are incorporated into this Agreement and take precedence over any conflicting provisions.


17. Termination

You may terminate this Agreement at any time by deactivating your account and ceasing use of all Services. Clans.AI may also terminate your access or account for any reason.


18. Miscellaneous

These Terms constitute the full agreement between you and Clans.AI. Our failure to enforce any provision is not a waiver of rights. Provisions found unenforceable will be modified to reflect the parties' intention.
